  2. No Unauthorized System Access or Network Abuse

    Customers shall not attempt to gain unauthorized access to systems, networks, or accounts belonging to others. This includes:

    1. Port scanning, probing, or conducting any form of network reconnaissance without permission.

    2. Intentionally disrupting or degrading network or server performance.

    3. Intentionally disrupting or degrading network or server performance.
  3. No Adult Content

  4. No Storage of Backups

    Intentionally disrupting or degrading network or server performance.

2. Zero Tolerance Spam Policy

HostNate has a zero-tolerance policy towards spamming. Customers are strictly prohibited from using HostNate's services for spamming purposes, including sending unsolicited bulk emails or engaging in any form of email abuse.

3. Defamation and Objectionable Content

Customers shall not use HostNate's services to publish, disseminate, or promote defamatory, abusive, threatening, or objectionable content that violates the rights of others or incites violence or hatred.

4. Enforcement:

HostNate reserves the right to investigate suspected violations of this Policy and take appropriate actions, including suspension or termination of services. HostNate may also cooperate with law enforcement authorities and share information related to potential violations.

Resellers of HostNate's services are responsible for ensuring that their customers comply with this Policy. Failure to do so may result in action taken against the reseller's account or services.

Infringement Policy

HostNate Pvt Limited ("HostNate") is committed to respecting the intellectual property rights of others and expects its customers ("Customers") to do the same. This Infringement Policy outlines the procedures for handling claims of intellectual property infringement and the actions HostNate may take in response to such claims.

Reporting Infringement:

Investigation and Response:

Upon receipt of a valid infringement notice, HostNate will promptly investigate the claim and may take the following actions:

  3. If the alleged infringer provides a counter-notice denying the infringement or asserting a legal right to use the content, HostNate may reinstate the content if permitted by law.

  4. If the alleged infringer does not respond to the notice or if the infringement claim is found to be valid, HostNate may take further actions, including the permanent removal of the infringing content and, in severe cases, termination of the Customer's services.

Repeat Infringers:

HostNate maintains a policy to address repeat infringers. Customers who are found to repeatedly infringe on the intellectual property rights of others may have their services terminated.

Protection of Customer Data:

HostNate respects the privacy and confidentiality of its Customers' data. Information provided in infringement notices will be handled in accordance with HostNate's Privacy Policy.

By using HostNate's services, Customers acknowledge that they have read, understood, and agreed to comply with this Infringement Policy. HostNate reserves the right to update this policy from time to time without prior notice.

Backup Policy

  5. Backup Storage Location:

    HostNate may store backup data in secure offsite locations to protect against data loss due to server failures or catastrophic events.

  6. Backup Schedule:

    The backup schedule will be determined by HostNate, and Customers will be informed of the backup frequency and timing.

  7. Backup Limitations:

    Customers are responsible for ensuring that their applications and databases are compatible with the backup process. Certain files or data may be excluded from backups based on technical limitations or security considerations.

  8. Data Restoration:

    In the event of data loss or corruption, Customers may request data restoration from the available backup sets. HostNate will make best efforts to restore data based on the latest available backup.

  9. Backup Responsibility:

    While HostNate provides backup services, it is ultimately the responsibility of Customers to maintain their own data backups and take precautions to safeguard critical data.

  10. Changes to Backup Policy:

    HostNate may update this Backup Policy from time to time without prior notice. Customers are encouraged to review this policy periodically to stay informed about any changes.

By using HostNate's backup services, Customers acknowledge that they have read, understood, and agreed to comply with this Backup Policy.

Data Request Policy

HostNate Pvt Limited ("HostNate") respects the privacy and confidentiality of its customers' ("Customers") data. This Data Request Policy outlines the procedures for handling requests from Customers related to their personal data and the guidelines for data access and retrieval.

Data Access Requests:

Data Deletion Requests:

Customers may request the deletion of their personal data from HostNate's records. Deletion requests should be made in writing to datarequest@hostnate.com and will be processed in accordance with applicable data protection laws and regulations.

Data Retention Period:

HostNate will retain Customers' personal data for the period specified in its Data Retention Policy. After the retention period has expired, HostNate will securely delete or anonymize the data.

Data Protection and Confidentiality:

HostNate will take appropriate measures to safeguard Customers' personal data and ensure its confidentiality, integrity, and security during the data request and retrieval process.

Changes to Data Request Policy:

Domain Registration Agreement

This Domain Registration Agreement ("Agreement") sets forth the terms and conditions governing the registration and use of domain names with HostNate Pvt Limited ("HostNate") by customers ("Customers" or "Registrants"). By registering a domain name through HostNate, Customers agree to be bound by the terms of this Agreement.

Domain Registration

HostNate provides domain registration services, allowing Customers to apply for the registration of domain names through accredited domain registrars. The registration process is subject to the policies and requirements of the relevant domain name registry.

Customer Representations and Warranties

By registering a domain name, Customers represent and warrant that:

  1. All information provided during the registration process is accurate, current, and complete.

    They have the legal authority to register the domain name.

    The registration and use of the domain name will not infringe upon the intellectual property rights of any third party.

    They will comply with all applicable laws and regulations related to domain name registration and use.

Domain Availability

Domain name registration is subject to availability. HostNate does not guarantee the availability of any specific domain name, and registration requests will be processed on a first-come, first-served basis.

Domain Ownership and Transfer

The domain name will be registered in the name of the Customer and will remain the property of the Customer during the registration period, subject to the terms of this Agreement.

Customers may transfer their domain names to another registrar, subject to the policies and procedures of the relevant domain name registry and applicable laws.

Domain Renewal

Customers have the option to renew their domain registration before the expiration date, subject to payment of the applicable renewal fees. Failure to renew a domain name before its expiration date may result in its release for registration by others.

Domain Suspension and Termination

HostNate reserves the right to suspend or terminate the registration of a domain name if the Customer violates any provision of this Agreement or if required by applicable laws or regulations.

Domain Privacy Protection

HostNate may offer domain privacy protection services to shield Customers' personal information from public WHOIS databases. Additional terms and fees may apply for domain privacy services.

Limitation of Liability

HostNate shall not be liable for any damages, losses, or expenses incurred by the Customer or any third party in connection with the domain registration, renewal, or use.

Indemnification

Customers agree to indemnify and hold HostNate harmless from any claims, losses, liabilities, or expenses arising out of the registration and use of the domain name.

Governing Law and Jurisdiction

When registering a domain name with HostNate Pvt Limited ("HostNate"), customers ("Registrants") are required to provide certain information for the domain registration process to be completed successfully. The following information is essential for the domain registration:

Registrants must specify the desired domain name they wish to register. The domain name should be unique and not already registered by another party.

Registrant Contact Information:
  1. Full Legal Name: The full legal name of the Registrant, which may be an individual or an organization.

  2. Postal Address: The postal address of the Registrant, including city, state/province, postal code, and country.

  3. Email Address: A valid email address that will be used for domain-related communication.

  4. Phone Number: A valid phone number for contact purposes.

Administrative Contact Information:

  1. Full Legal Name: The full legal name of the Administrative Contact, who may be different from the Registrant.

  2. Postal Address: The postal address of the Administrative Contact, including city, state/province, postal code, and country.

  3. Email Address: A valid email address for administrative communication.

  4. Phone Number: A valid phone number for administrative contact.

Technical Contact Information::

  1. Full Legal Name: The full legal name of the Administrative Contact, who may be different from the Registrant.

  2. Postal Address: The postal address of the Administrative Contact, including city, state/province, postal code, and country.

  3. Email Address: A valid email address for administrative communication.

  4. Phone Number: A valid phone number for administrative contact.

Billing Contact Information:

  1. Full Legal Name: The full legal name of the Administrative Contact, who may be different from the Registrant.

  2. Postal Address: The postal address of the Administrative Contact, including city, state/province, postal code, and country.

  3. Email Address: A valid email address for administrative communication.

  4. Phone Number: A valid phone number for administrative contact.

Name Server Information:

Registrants must provide the name server information for the domain name. This includes the primary and secondary name servers responsible for handling DNS records and managing the domain's online presence.

Payment Information:

Payment details, such as credit card information or other accepted payment methods, are required to complete the domain registration process. HostNate uses secure payment processing methods to protect the confidentiality of payment data.

Registrants are responsible for ensuring the accuracy and validity of the provided registration details. Providing false or inaccurate information may lead to registration errors or potential domain ownership disputes.

By submitting the required domain registration information, Registrants acknowledge that they have read, understood, and agreed to comply with the domain registration process and the applicable terms and conditions.

Customer Hosting Agreement

This Customer Hosting Agreement ("Agreement") sets forth the terms and conditions governing the provision of hosting services by HostNate Pvt Limited ("HostNate") to its customers ("Customers" or "You"). By signing up for or using any hosting services offered by HostNate, You agree to be bound by the terms of this Agreement.

1. Hosting Services

HostNate provides web hosting services that allow Customers to publish, manage, and maintain websites and web applications on HostNate's servers.

2. Customer Responsibilities

  1. Compliance

    You agree to comply with all applicable laws, regulations, and industry standards while using HostNate's hosting services.

  2. Website Content:

    You are solely responsible for the content you publish on your website hosted by HostNate. You must ensure that the content does not infringe on the intellectual property rights of others or violate any applicable laws or regulations.

  3. Security Measures:

    You are responsible for implementing and maintaining appropriate security measures to protect your website and data from unauthorized access or misuse.

  4. Backup and Data Loss:

    While HostNate may offer backup services, it is Your responsibility to maintain backup copies of your website and data. HostNate shall not be liable for any data loss or damages resulting from the lack of data backups.

3. Hosting Fees and Payment

  1. Fees

    You agree to pay the fees for the hosting services as specified in the selected hosting plan or package.

  2. Payment:

    Payment for hosting services shall be made in advance, and HostNate will provide payment options and instructions. Failure to make timely payments may result in the suspension or termination of hosting services.

  3. Automatic Renewals:

    Hosting services may automatically renew at the end of each billing cycle unless you opt-out or cancel the service before the renewal date.

4. Service Level Agreement (SLA)

This Customer Digital Certificate Agreement ("Agreement") outlines the terms and conditions governing the issuance and use of digital certificates by HostNate Pvt Limited ("HostNate") to its customers ("Customers" or "You"). By applying for and using a digital certificate from HostNate, You agree to be bound by the terms of this Agreement.

1. Digital Certificate Services

HostNate provides digital certificate services that enable Customers to secure their online communications and transactions through the use of cryptographic keys and digital signatures.

2.Certificate Issuance.

  1. Customer Identity Verification:

    You agree to provide accurate and complete information during the certificate application process. HostNate may verify Your identity through a validation process, and You consent to cooperate in such verification.

  2. Certificate Validity:

    Digital certificates issued by HostNate have a specified validity period, after which the certificate will expire and become invalid. It is Your responsibility to renew or replace the certificate before its expiration.

3. Certificate Usage

  1. Private Key Security:

    You are solely responsible for maintaining the confidentiality and security of Your digital certificate's private key. You must not share, disclose, or transfer the private key to any third party.

  2. Prohibited Activities:

    You agree not to use the digital certificate for any illegal, fraudulent, or malicious activities. HostNate may revoke the certificate if there is evidence of misuse or violation of this Agreement.

  3. Certificate Backup:

    It is Your responsibility to create and securely store a backup of Your digital certificate's private key to prevent data loss in case of hardware failure or other issues.

4. Certificate Revocation

HostNate reserves the right to revoke a digital certificate if:

    You fail to comply with the terms of this Agreement or any applicable laws or regulations.

    The certificate information is found to be inaccurate or outdated.

    The certificate's private key is compromised or suspected to be compromised.

    There is a legal or regulatory requirement to revoke the certificate.

5. Limitation of Liability

HostNate shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or misuse of the digital certificate, including but not limited to data breaches, financial losses, or business interruptions.

6. Certificate Renewal and Expiration

You are responsible for timely renewing the digital certificate before its expiration to maintain uninterrupted services. HostNate will notify You of the certificate's upcoming expiration, but it is Your responsibility to initiate the renewal process.

7. Amendments

HostNate may update or modify this Agreement from time to time. Customers will be notified of any changes, and the revised Agreement will be made available on HostNate's website.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts in [Jurisdiction].
